Replanting authorisations are authorisations to plant vineyards on an area equivalent, in terms of pure crop, to the area grubbed up and granted to producers who have submitted the relevant application since 1 January 2016.
The replanting authorisations referred to in this Article shall be used on the same holding where the grubbing-up took place and shall not be transferable.
They shall be valid for three (3) years from the date on which they were granted.
Applications for replanting authorisations may be submitted until the end of the second wine year following that in which the grubbing-up took place. In the event of non-compliance with these deadlines, no replanting authorisation shall be granted.
No authorisations for the replanting of vineyards shall be granted in cases of grubbing-up of unauthorised plantings referred to in Article 71 of Regulation (EU) No 1308/2013.
Replanting authorisations shall be forfeited if they are not used during their period of validity.

Where the producer does not use at least 80 % of the replanting authorisation granted% the area within the prescribed time limit of three (3) years, then it is subject to the exclusion of submitting a new application / solemn declaration for a new planting authorisation for the following two (2) calendar years unless an objection is accepted for reasons of force majeure.
· Any natural or legal person who intends to grub up a vineyard in order to obtain a replanting permit shall submit to the competent Directorate of Rural Economy and Veterinary Medicine/Agricultural Economy to which the parcel belongs an application for , at any time during the year.
The application shall be administratively checked and then examined by an on-the-spot check in the presence of the applicant or his representative, no later than thirty (30) days after its submission. The day of submission means the day on which the application is registered with the competent service.
After the on-the-spot check has been carried out, relevant inspection records shall be drawn up for each of the parcels to be checked in order to be able to enter the findings of the on-the-spot check in the Vineyard Register.
After the on-the-spot check, the applicant grubs up the vineyard without further notice and then informs the competent department. However, applications for replanting authorisation may also be submitted after the grubbing-up has taken place. In this case, the competent DAOK should carry out an administrative check establishing the existence of the vineyard up to two wine years before the date of the application. The administrative check concerns the entry of the parcel in the vineyard register and the harvest declarations of that parcel that the producer should have submitted.
Following an on-the-spot check, the Directorate for Rural Economy and Veterinary Medicine/Agricultural Economy establishes the grubbing-up, draws up the relevant on-the-spot check report in accordance with and then grants the applicant a replanting authorisation.
The procedure for granting a replanting authorisation may not exceed a total period of three months from the submission of the application.
All changes must be recorded in the vineyard register.
The replanting authorisations granted by the Directorates for Rural Economy and Veterinary Medicine/Agricultural Economy are recorded and sent electronically after the end of each wine year (31 July) and no later than 30 September each year to the Directorate for Cultivation Systems - Department of Vine and Olive.
